Police ordered to recover minor from ‘illegal custody’
LAHORE: The Lahore High Court Thursday directed the police concerned to recover minor daughter of a Malaysian woman from ‘illegal’ custody of her paternal grandmother in Faisalabad.
Justice Farrukh Gulzar Awan directed the DSP Nishatabad to produce the girl and the grandmother on Aug 10.
Malaysian woman has moved the Lahore High Court for recovery of her minor daughter from her Pakistani in-laws who brought the girl to Pakistan and allegedly are keeping her in illegal custody.
Areha Eman, the Malaysian woman, stated that she married Pakistani man, Moaz Khalid, a resident of Ulu Tiram Johar, Malaysia, on July 31, 2012. She gave birth to a daughter Arifa after one year.
The petitioner stated that later clashes started between them on petty issues and ultimately in March 2014, Moaz’s mother Muniza Khalid brought her daughter to Pakistan promising that she would bring her back to Malaysia after meeting with her other family members in Pakistan. She said more than one year had passed but so far Muniza did not bring her back. She said few days back she came to Pakistan and went to the house of Muniza in Faisalabad, but they did not let her enter their house and misbehaved with her.
She said she approached the police concerned for registration of FIR for keeping her daughter in illegal custody but the police did not register a case. She said they were asking for a court direction to proceed for recovery of the girl.
She said her husband was still living in Malaysia and doing his job there. She said they were merely separated and no divorce had taken place. She said her mother in-law brought her daughter here in connivance with her son Moaz. She prayed the court that she was the real guardian of minor daughter according to the Pakistani family laws. She requested the court to recover her daughter from illegal confinement of her in-laws and give into her permanent custody.
She also requested the court for direction for legal action against the responsible for keeping her daughter in illegal custody.
